Defendant’s nephew testified
In Defendant v. Clark, the defendant was convicted on five counts of aggravated felonious sexual assault and one count of attempted aggravated felonious sexual assault. On appeal, the defendant argued that the State should admit evidence regarding the victim’s change in gender identity and his display of pornographic pictures to his nephews, but the trial court disagreed, concluding that the State had properly addressed these issues in voir dire.
Defendant’s nephew testified that his nephew showed his nephew sexual positions with pictures of the accused. Defendant denied doing this, saying that the child had made up the allegations when he was older. However, he did admit to touching his nephew, and his nephew testified that Defendant had taken pictures of him in sexual positions and then sent them to his niece.
Defendant’s niece testified
Defendant’s niece testified that he molested her twice, the first time in 2005, and the second time in 2006. When the victim’s niece testified, she stated that she was afraid of the defendant because he was taller and stronger than her. Despite this, the defendant was kind and did not discipline her, even though he had spanked her when he got angry.
Victim was about 16 or 17 years old when the incident occurred, and testified that she called her brother to let him know. She told him she was angry and said it hurt every time she thought about it. She also said that she was angry with the defendant, but that she did not blame him for her brother’s death.
Defendant’s mother testified
The defense presented B.E.’s testimony, which was reluctant to detail the events but provided some significant testimony. She testified that the defendant stripped off her clothing and did things to her that she did not like, including touching her booty. She also testified that the defendant had a gun.
The judge limited the defendant’s mother’s testimony to a few details of the alleged offense. Although defendant denied sexual contact with B.E., the testimony provided by the defendant’s mother provided substantive evidence of the alleged crimes, and it provided a specific date. A fresh complaint, however, may not contain details of the alleged assault that the mother did not relate.
Defendant’s aunt testified
Defendant’s aunt Cerda testified that her daughter and nephew visited defendant and P.W. during the spring and summer of 2009, and observed them together. She testified that she felt the defendant’s hands on her thighs and legs on either side of her. After this incident, she was very scared.
She was 16 years old at the time, and had never seen defendant act in an inappropriate manner with the plaintiff. She also testified that she did not notice defendant’s son watching any dirty movies with the plaintiff. The defendant had a friend named Ricky, and they called him “Uncle Ricky.”
She said the defendant raped her niece and nephew during the summer of 2007. Defendant’s aunt testified that she saw the defendant’s nephew in bed with her niece, but did not notice him. Afterward, the two girls went to the beach, where defendant was lying. They then went to a beach, and the defendant was lying on a towel. During the sexual acts, the victims were not aware of each other.
Defendant’s uncle testified
Defendant’s uncle testified that the defendant instructed the girls to place their cell phones in a drawer and not to take pictures of their private parts. The pictures were meant to mimic the sexual positions that defendant used on his victims. The pictures were also used to teach the girls how to perform various “hand jobs.”
